In one book, I named a bistro "Geschlossen vom Gesundheitsamt" (Closed by the Health Department). Of course, my point was to make fun of snooty gourmet restaurants, so it worked well; readers who bothered to translate it got an easter egg.

Well I am a bit late coming to this. And happy New Year. The bottom line is, if an entity can afford to sue, it often will, disclaimers or not. And can you afford to fight? They will have to prove harm, but if you cannot afford to argue via a lawyer, then tough. One thing to keep in mind though is, how likely is the real person/place to see what has been written/said? But the easy way around this is to not mention the shop's name.

Defamation is a bit different from trademark or business name infringement [your two examples aren't defamation cases], and while courts in different political jurisdictions operate differently some cases are filed simply to be a nuisance with the hope the defendant can't afford to fight the suit. And yes, you are correct it happens a lot.

And yes, you are correct it happens a lot. Well that is true, but it's two examples of how corporate lawyers can try to stamp on people. I guess in away it's defamation by association. "How dare some other inferior place use our name? What will be people think?!"
